Immediately After the Accident
If you are involved in an accident, your first thoughts should be about the health of everyone involved. If you or anyone else has been seriously hurt, immediately call for an ambulance. Next, you should consider whether the vehicles involved in the accident are in a safe location. If the vehicles need to be moved for traffic safety, take pictures of the accident beforehand if it is safe to do so. Once the cars are in a safe location, examine the damages to the vehicles. If any of the vehicles have been damaged or you believe that anyone has been injured, contact the police to report the accident.
While you are waiting for the police, you should try to collect the information of any witnesses to the accident. You should also make sure to take pictures of damages and your surroundings. When the police arrive, you should not make any statements about whether or not the accident was your fault. Consult with an attorney about liability.
The State of Florida requires that its drivers have $10,000.00 of Personal Injury Protection (PIP) insurance coverage. PIP coverage comes from your own insurance company and is paid regardless of fault. PIP insurance may also cover loss of income resulting from your injury. You should contact your PIP insurance carrier on the day of an accident and let them know what happened.
If the driver of another vehicle was at fault in the accident, consult with an attorney about recovering damages from his or her insurance. If the vehicle at fault was a company vehicle being used by an employee for work purposes, the employer may be liable for damages you suffered. Before you can recover medical expenses from a third party, you must first exhaust your PIP benefits. The third party may also be liable for lost wages and pain and suffering that resulted from the accident.
